Terms of Service

Last updated 18 October 2026

These Terms of Service govern your access to and use of CapiMail. By creating a workspace or sending email through CapiMail, you agree to these terms, our Acceptable Use Policy, and our Anti-Spam Policy.

Your account

  • You are responsible for activity under your workspace and for keeping credentials and API keys secure.
  • Sending access requires a verified sending domain and approval; we may decline or revoke access.
  • You must provide accurate organization information and keep it current.

Acceptable use and sending

Your use of CapiMail must comply with our Acceptable Use and Anti-Spam Policies and with applicable law, including email and data-protection regulations in the jurisdictions you send to. You are responsible for obtaining and maintaining consent for the recipients you contact.

Credits and billing

  • Sending consumes prepaid credits. A credit is reserved when a send is accepted and settled when it is delivered or finally resolved.
  • Messages that cannot be sent are not charged; reserved credit is returned to your balance.
  • Credit purchases and balances are recorded in an auditable ledger. Prices and packages may change prospectively.

Service availability and changes

We work to keep CapiMail reliable and provide the service on an “as available” basis. We may change, suspend, or discontinue features, and we may pause sending to protect platform deliverability and other customers.

Suspension and termination

We may suspend or terminate access for violations of these terms or our policies, for non-payment, or to protect the platform. You may stop using CapiMail at any time; certain records are retained as described in our Privacy Policy and for legal and audit purposes.

Liability

To the extent permitted by law, CapiMail is not liable for indirect or consequential damages, and our aggregate liability for any claim is limited to the amount you paid for the service in the three months before the event giving rise to the claim. Nothing here excludes liability that cannot be excluded by law.
